BMS Service Agreement.
This Business
Multiplier System (BMS) program agreement is presented to you by Direct Product
Network, Inc., a California corporation, and consists of the “BMS” promotional
packages presented here and selected by the undersigning, representing the business to be promoted
(Company), subject to the terms
and conditions explained below:
Terms
and conditions: Once signed,
this agreement will be in effect for an initial period of twelve (12) months,
after which this agreement will automatically renew for successive periods of
one (1) year each, unless terminated earlier as permitted by this agreement.
During the term, Company agrees to use BMS as its exclusive provider of prepaid
value cards, including related card fulfillment processing services.
Direct Product
Network will promote your company, by surveys; postcards and “cash
certificates” delivered by direct mail to potential customers in a five-mile
radius of your company’s location. A minimum of five hundred printed postcards
will be mailed, and will include company name, location and the services
provided by company. Extra “cash certificates” will have a $5 production
charge.
Company agrees
to honor the “cash certificates” at face value, and exchange “cash
certificates” for products or services of the company with no restrictions to
the user of the “cash certificate”. The
face value of the “cash certificates” will be reimbursed directly to company by
Direct Product Network, Inc. Allow one month after today’s date to start
receiving new customers.
Company will
provide art materials such as logos, slogans or any particular information to
be added on the “cash certificates” and promotional materials, which will be
pre-approved by BMS before printing. It is understood that the “cash
certificates” will have the same design for twelve months, if for some reason
company want to change design on the “cash certificates”, it will have a cost
of $200.00 (Two hundred dollars).
This agreement
is only for one location ONLY, it cannot be combined. If company has more than
one location, participation of other locations will be under a separate
agreement.
Cancellation Policy: BMS customer can cancel program at any time.
Set up fee and paid monthly fees will not be refunded.
Money Back Guaranteed. BMS will deliver the cash
certificates promised on the program chosen by company, if for any reason
less “cash certificates” are redeemed in any given month, BMS will either
rollover the difference on “cash certificates” from the previous month to
the next, or refund the amount remaining in “cash certificates” in cash.
Acknowledgement. By signing below Company acknowledges that it has
read, understands and agrees to be bound by all the terms and conditions of
this agreement and this agreement constitutes a valid and binding legal
obligation of company and is enforceable against company in accordance with its
terms. The individual signing this agreement on behalf of company hereby
represents and warrants that she/he has the authority to bind the company.
